·         initiate and/or pursue any form of legal redress;

·         comply with orders, directions, requirements, guidelines and/or requests made or existing under any applicable laws, and/or by or from any courts, governmental, statutory or regulatory bodies, (whether of Malaysia or elsewhere), with which we or our affiliates/associated companies are expected to comply;

·         conduct direct marketing via email, telephone and/or other means of communication if you have separately indicated your consent to receiving such direct marketing materials;

·         facilitate services from third party service providers to whom such Personal Data as may be relevant has to be disclosed for such services provided you have previously consented to such disclosure.

 

In compliance with the PDPA, we will not send marketing messages to a Malaysia telephone or facsimile number belonging to you unless you have given us clear and unambiguous consent to do so – as reiterated in “Other Uses”. If you have previously given us consent, we may send you marketing messages until you advise us in writing that you wish to withdraw your consent.

 

Exceptions to the Requirement of Consent

Notwithstanding anything to the contrary in the foregoing, the Second, Third and Fourth Schedules of the PDPA (which are publicly available at https://www.kkd.gov.my/pdf/Personal Data Protection Act 2010.pdf) set out the exceptions that permit the collection, use and disclosure of Personal Data without your consent.

 

Disclosure and Transfer of Personal Data to Third Parties and/or Outside of Malaysia

We do not disclose Personal Data to third parties except when required by law; when we have the individual’s consent or deemed consent; or in cases where we have engaged third parties such as data intermediaries or subcontractors specifically to assist us. Any such third parties whom we engage will be bound contractually to keep all information confidential. We do not sell, rent, licence or otherwise disclose your Personal Data to third parties. You hereby authorize us to transfer your Personal Data to such third parties, who will process your Personal Data in accordance with this Privacy Policy. We will endeavour to provide adequate protection and supervision over the handling of your Personal Data that is transferred by us to third parties. In the event any such third party is outside of Malaysia, we will take such measures to ensure that such overseas recipients are legally bound to provide a standard of protection to the Personal Data so transferred that is comparable to the protection under the PDPA.

 

WITHDRAW CONSENT, REQUEST ACCESS TO AND CORRECTION OF PERSONAL DATA

1.    You have the right to withdraw consent, request access to or make corrections to the Personal Data that we hold about you in accordance with applicable laws

All requests for withdrawal of consent, access to, or correction of Personal Data held by us shall be made in writing or via email addressed to our Data Protection Officer.

2.    If you believe that any information, we hold about you is incorrect, incomplete, and/or outdated, please contact our Data Protection Officer. Within a reasonable time upon receipt of your notification of any incorrect, incomplete and/or outdated information, we will correct and/or update the information in your Personal Data in accordance with the requirements of the PDPA.

3.    We may charge a fee for processing your requests for access to Personal Data in accordance with the requirements of the PDPA. If so, we will inform you of the fee before processing your request.

4.    Please note that if your Personal Data has been provided to us by a third party (for example, a general practitioner) you should contact that organization or individual to make such queries, complaints, and access any correction request to us on your behalf.

5.    We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under applicable laws).

6.    If you withdraw your consent to any or all use of your Personal Data, depending on the nature of your request, we may not be in a position to continue to provide our services to you, or administer any contractual relationship in place, which in turn may result in the termination of any agreements with us.

7.    You may choose to unsubscribe from our mailing lists or registrations or elect not to receive further marketing information from us, by contacting our Data Protection Officer. Where applicable, you may also unsubscribe from receiving automated e-mails from us by using the “unsubscribe” function provided.

GOVERNING LAW

The terms and conditions of this Privacy Policy are governed by the laws of Malaysia. In the event of any disputes arising from this Privacy Policy, you must first contact our Data Protection Officer regarding your concern and use your best endeavours to amicably settle any dispute in good faith. We on our part will also use our best endeavours to amicably settle your concerns in good faith.
